General terms and conditions

1. General scope

In our online shop "www.auto-per-mausklick.de" we offer vehicles to end users. Our general terms and conditions apply to all mutual claims from and in connection with the conclusion of the contract with regard to the vehicles offered in our online shop "www.auto-per-mausklick.de".

We do not recognize customer conditions that contradict or deviate from our general terms and conditions, unless we have expressly agreed to their validity. Our general terms and conditions also apply if we carry out the delivery without reservation in the knowledge of conflicting or deviating conditions of the customer. Individual agreements have priority.

Our general terms and conditions apply to both consumers and entrepreneurs, unless we have explicitly made a differentiation in the respective clause.

2. Offer and conclusion of contract / technical process / storage of the contract text

The offers in our online shop are non-binding and subject to change. The contract language is German. Upon request, we will also send you the contract in English or French. In the event of deviations between the German version and the translation, the German version has priority. The specific content of the contract can be found in the respective offer.

By sending us the contract documents (see next section) you are making a binding offer to us to conclude a contract with you. You will then immediately receive a confirmation of receipt of the order. This does not yet represent an acceptance. The contract is only concluded when we accept the offer by sending the order confirmation or send the goods.

In our online shop, the ordering process involves several steps. In the first step, select the vehicle and then the model and the vehicle type by clicking on it and then click on "configure now". In the next step of the ordering process, click on the offered alternatives to select the engine, the vehicle color, any special equipment, the wheels, the upholstery and the seats as well as any special packages. At the end of the respective selection process, please click on "continue". After completing the configuration, you will get an overview showing the manufacturer price, our price, the price for the special equipment and the transfer costs as well as the final price. The order process along with all the information can now be viewed as a whole. You can review the information and make changes. To continue the order process, please click on "Inquire now without obligation". In the new window, please indicate whether you are a private or commercial buyer and enter your name and your contact details in the fields provided. If you would like a loan for your new car, a trade-in for your old vehicle or if you would like the contract documents to be sent in English, please tick each and click on “send” at the end. You will then receive an email from us with a PDF -Document containing the prepared sales contract. By returning the fully completed and signed form together with a copy of your identity card or passport with a registration certificate to us by e-mail, fax or post, you are making an offer to conclude a purchase contract for the vehicle you have specified and configured. A contract is only concluded when we accept your offer in writing to you.

During the entire ordering process, you have the option of checking and correcting the entries you have made at any time by selecting the "back" button in your browser and then making the appropriate changes. By closing the browser, you can cancel the entire ordering process at any time.

The contract will be stored by us. We will send you the terms and conditions and the order confirmation by email.

You can also archive the data of your order by downloading the terms and conditions and using the functions of your browser to save the data summarized on the last page of the order process.

3. Price, transfer costs and delivery times, right of withdrawal of the EU Neuwagen Knott GmbH

The prices shown by us are final prices including 19% sales tax. The transfer costs are included in the final price, which is specified after completing the order process.

Delivery to our adress is already included in the price of the vehicle. If you would prefer a shipment of the car to your deitnation, the delivery costs a small additional charge. A delivery to other European countries is only possible with a special agreement with us.

Unless otherwise agreed, delivery times are non-binding. A specified delivery period begins with the conclusion of the contract.

Compliance with a specified delivery deadline is subject to timely self-delivery. If our ability to deliver depends on delivery from the manufacturer or a pre-supplier and this delivery fails for reasons for which we are not responsible, we are allowed to withdraw from the sales contract. In this case, we are obliged to immediately reimburse any consideration received from the customer. We are also obliged to withdraw from the purchase contract if delivery becomes significantly more difficult or impossible as a result of force majeure. In these cases, the customer is not entitled to any compensation. Any withdrawal by us will be made in written form to the customer. We are obliged to inform the customer immediately about the unavailability.

If we are unable to deliver the vehicle within 4 months of the end of the specified non-binding delivery period, the customer is entitled to withdraw from the purchase contract. The customer is only entitled to compensation for non-performance if we acted with intent or gross negligence.

If delivery of the vehicle is not possible within the delivery period due to force majeure, the customer is not entitled to withdraw from the purchase contract until 6 months after the end of the specified non-binding delivery period. The customer is only entitled to compensation for non-performance if we acted with intent or gross negligence.

In the event of withdrawal, payments that have already been provided by the customer will be returned immediately.

4. Payment options and terms

Payment of the agreed purchase price (final price) is made either by transfer to our account, by cash payment or by a bank-confirmed check when the vehicle is collected from our business premises.

When delivering to the address given by the customer, payment is made exclusively by bank transfer. We only send the vehicle documents (invoice, certificate for the registration office, COC and other documents, if applicable) after receipt of full payment.

With the notification to the customer that the car is in stock, we send the customer the invoice. This is due immediately upon receipt.

For customers without a registered address in Germany (private customers) or without a permanent address in Germany (commercial customers), a deposit of 10% of the final price shown is due upon conclusion of the contract.

5. Retention of title

We retain ownership of the delivered vehicle until the purchase price (final price) has been fully paid.

6. Cancellation policy and sample cancellation form

In principle, there is a right of withdrawal with a distance contract. However, this does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer. When ordering new EU vehicles, select the equipment features you require as part of the configuration of the vehicle so that the vehicle is not prefabricated but is based on your individual selection. In these cases there is no right of withdrawal. However, in the case of ordering vehicles in stock, consumers have a right of withdrawal in accordance with the following provisions.

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier has taken possession of the goods. by means of a clear declaration (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.

Consequences of the withdrawal

If you cancel this contract, we have to repay all payments that we have received from you immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. We will use the same means of payment for this repayment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment. You bear the direct costs of returning the goods. We can refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. We bear the costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.

We are also unrestrictedly liable for intent and gross negligence. In the event of slight negligence, we are only liable for the violation of cardinal obligations, i.e. Obligations that are to be granted to you according to the meaning and purpose of the specific contract or the fulfillment of which enables the proper execution of the contract in the first place and which you can regularly rely on to be observed. However, we are not liable for indirect or unforeseeable damage, consequential damage caused by defects, for lost profit or for no savings. Otherwise, our liability for slight negligence is excluded. The limitation of liability also applies to our vicarious agents.

9. Data protection

The customer data collected and stored by us are used exclusively for the purpose of contract processing. The first and last name of the customer, the associated billing or delivery address as well as the email address and telephone number are saved.

The personal data transmitted to us will only be stored for as long as this is necessary due to the purpose associated with the data transmission. The data stored by us will not be passed on to third parties, with the exception of the data transfer to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of the goods, and the transfer of the data due to legal obligations and in the case of your express prior consent. A revocation of the granted use is also possible at any time.

10. Complaints procedure / out-of-court dispute resolution

11. Applicable law and place of jurisdiction
